Senate Bill 6, Chapter 899, Statutes of 2004 (Alpert), as a part of the Williams Settlement, established the Emergency Repair Program (ERP). The funding is now available to schools identified by the California Department of Education (CDE) as ranked in deciles one, two, or three based on the 2006 Academic Performance Index (API). The list of schools meeting the API criteria has been published by the CDE and is available on the CDE Website.

This program provides grant funding as well as funding to reimburse Local Educational Agencies (LEAs) for the cost of repairing or replacing existing building systems or structural components that are broken or not functioning properly and that pose a health and safety threat to students and staff at eligible school sites.  Funds will be made available annually through the Budget Act and the program will operate until $800 million has been allocated.

To apply for funding, the LEA must verify that it has met the "supplement, not supplant" requirement stipulated in ERP Regulation, Section 1859.328, and that the school is eligible (meets the above API criteria).  All applications must include: 

  • Grant Request (Form SAB 61-03)
  • Documentation to substantiate the Health or safety hazard, including, but not limited to:
    • Photos showing the condition of the project prior to the repair work being performed
    • Signed copy of an Interim Evaluation Instrument identifying the health and safety threat
    • Copy of complaint(s) made by parents, students, or staff referencing the problem
    • Copy of inspection report by qualified individual(s) or firm(s)
    • Work orders that describe the hazard and the work necessary to mitigate the hazard
  • Detailed Cost Estimate, prepared by a qualified individual or firm. Must include a breakdown of the estimated expenditures associated with planning, repair/replacement, testing, inspection, and administrative/filing fees.
  • Expenditure Report (Form SAB 61-04) Must be submitted concurrently if requesting reimbursement.
  • The LEA is required to retain additional documentation on file. See instructions on the Form SAB 61-03 and Form SAB 61-04 for additional required documentation.

If applying for a grant, LEAs must first submit the Grant Request (Form SAB 61-03) and then submit the Expenditure Report (Form SAB 61-04) after the emergency repair or replacement is complete.  The LEA must complete all work reported in the Form SAB 61-03 and submit the Form SAB 61-04 within 12 months of the State Allocation Board (SAB) apportionment date, if no Division of the State Architect (DSA) plan approval is required. If DSA plan approval is required, the LEA has 18 months to complete the emergency repair or replacement and submit the Form SAB 61-04.

Emergency Repair Projects - Workload list

Please note that all projects are listed by date order received.  The applications are being processed as they become complete to the next available SAB meeting. Please note that the document also includes a listing of ERP projects apportioned by the SAB. If you have questions about a particular project, please contact your project manager.

Pre-Assessment Request

The Pre-Assessment process has been discontinued.  However, the OPSC will retain Pre-Assessment Requests previously submitted on file until the LEA submits a complete Form SAB 61-03.  LEAs that have submitted Pre-Assessment Requests should include a copy of the OPSC response letter with their Form SAB 61-03. 


Instead of the Pre-Assessment process, LEAs can submit a completed Form SAB 61-03 along with the required supporting documents to request a grant in order to efficiently facilitate the emergency repairs.
