Lease-Purchase Program: Joint-Use Program

General Information
The Lease Purchase Program (LPP) Joint Use was scheduled to end after the May 31, 2003 application deadline; however, at the July 2003 State Allocation Board (SAB) meeting, the Board continued this Joint-Use Program for one last year. The apportionments for the final funding cycle were made at the August 4, 2004, SAB. Since all funds were exhausted, the SAB authorized the Office of Public School Construction to advise school districts that it would not be accepting any more applications.

For those projects approved by the August 4 SAB, state funds will be released to the district upon certification that a Construction Contract Certification for Joint Use (Form SAB 599 JU), for the facility has been executed, and the district has submitted a fully executed Agreement - Joint Use (Form SAB 518 JU). As a cautionary note, the construction contract may not have been signed prior to SAB approval for either a funded or unfunded project. Funds not released within one year of apportionment are subject to rescission pursuant to existing "Time Limits on Apportionments" policy under the LPP. Furthermore, the three percent Disabled Veteran Business Enterprise participation goal shall apply to each LPP Joint-Use project, and the Prime Bidder Certification Form and Good Faith Effort Worksheet Form must be retained by the district.

Keeping in mind there is approximately $62 million in funding available for School Facility Program (SFP) Joint-Use projects, districts may wish to explore the SFP Joint-Use Program. The filing deadline for SAB consideration is May 31, 2006. Available on the OPSC website is the SFP Joint-Use Application (Form SAB 50-07), and the Assembly Bill 16 Regulations (SFP Regulations).
