Regulations: SFP Proposed Regulations

Regulatory Preview
New and/or amended regulations have been approved by the State Allocation Board (SAB). SAB approval and the effective date of regulations are two different things. Until the regulations become effective, the following is provided simply as a helpful preview for your information.

The timing of when the regulations become effective depends upon whether or not the regulations were approved by the SAB on an emergency basis. Typically, emergency regulatory tracts take approximately 30-45 days to become an effective emergency regulation after they are approved by the State Allocation Board and prior to filing with the Office of Administrative Law (OAL). Non-emergency regulatory tracts take 120-180 days from the date the SAB approves the agenda item until the regulation(s) become effective.

Joint-Use Program Amendments
Defines Non-Profit Organizations for purposes of qualifying as a Joint-Use Partner, clarifies the requirements for use of local bond measure funds, and changes the application filing timeframes.

Project Information Worksheet (P.I.W.) Material Inaccuracies

Gives protections to school districts that "Material Inaccuracy Penalties"  are inapplicable to P.I.W. construction cost data submittals of "the best available information at the time of filing."

Overcrowding Relief Grant (ORG) Amendments

Financial Hardship districts will be eligible for ORG advance site acquisition funding for condemnation actions.  July 31, 2009 and January 29, 2010 are added as application cutoff dates for future funding cycles.  Relief of overcrowding must be demonstrated by increasing useable outdoor space for uses such as play areas, green space, or outdoor lunch areas.

Implementation of Assembly Bill 1014 (Education Code Sec. 17071.75).

Adds the following components to the enrollment projection calculation method to establish eligibility for SFP new construction funding:
• Modified weighting mechanisms;
• Birth rate augmentation to kindergarten and first grade enrollment;
• Tenth-year projection; and,
• Utilization of pupil residence for High School Attendance Area  reporting.
